Medication Errors

According to the Federal Food and Drug Administration (FDA), medication errors cause at least one death every day and injure approximately 1.3 million people annually in the United States. At the Scanlan Law Group, we have more than 25 years of experience in representing the victims of medical malpractice, including individuals who have been victimized by medication errors.

There are many sources of medication errors. Some of the more common medication errors include:

  • The physician's failure to obtain an accurate patient history. For example, the physician fails to ask the patient about his or her allergies to medicines, fails to ask what other medications the patient is taking, or fails to review the patient's complete medical history before prescribing a medication.

  • The physician's failure to keep up-to-date with the latest drug information.

  • The physician or pharmacist's failure to adequately explain instructions for using a medication.

  • The failure to monitor the patient's use of and reactions to a medication.

  • The failure to monitor the patient's use of and reactions to a medication.

  • Poorly written prescriptions, improper abbreviations, or ambiguous dosing instructions, leading to a pharmacist's error.

  • Poor pharmacy practices, such as prescription mislabeling.

Whatever the cause of the medication error, it is a serious health problem, and it is expected to increase as more and more drugs become available on an over the counter basis, as our senior citizens take more and more drugs, and as the health insurance crisis increases the pressure on doctors to keep their costs to a minimum.
