Mold
Although mold related litigation is a relatively new type of injury claim, the lawyers of the Scanlan Law Group bring with them their 25 years of injury law experience in the fight against those responsible for this incredibly toxic substance.
Mold is a naturally occurring microscopic form of fungus that thrives in warm, moist environments both indoors and outdoors. Mold spreads itself throughout the environment by creating spores, which then circulate through the air and water, and even through insects. When mold spores come to rest in a damp or humid area, they multiply rapidly by digesting whatever surfaces they come into contact with-wood, carpeting, food, and other natural and manmade materials. Some scientists estimate that there are hundreds of thousands of different varieties of mold.
Although most molds are harmless (think of the green growth found on old cheese in your refrigerator), a few molds are believed to be extremely toxic and have been linked to a wide variety of serious health problems. The toxic varieties of mold give off a toxic substance known as mycotoxin, which is believed to be responsible for the majority of the health problems associated with mold. The most harmful variety of mold is Stachybotrys, more commonly known as black mold, which is frequently found in water-damaged building materials.
Many individuals are sensitive to mold, and can suffer from nasal stuffiness, eye irritation, and minor breathing discomfort as a result of mold exposure. For individuals who are allergic to mold, or those that have experienced long-term exposure to mold in, for example, their homes or work environments, the effects of mold exposure can be much more serious. Such individuals may experience, fevers, respiratory diseases, asthma, allergies, skin rashes and various fungal diseases. Additionally pulmonary hemorrhaging and brain damage resulting in memory loss have been linked to long-term mold exposure.
There are many potentially responsible parties in a mold case-contractors, subcontractors, developers, architects, landlords, construction managers, mold removal contractors and other parties involved in the design, engineering, building and repair of residential and commercial properties. The potential damages include all health related injuries, the cost of any mold remediation, and property damages.
